Bar Exam (US) Criminal Law: Hayden, a first year student at Georgia Law School, worked as a part...

Question

Hayden, a first year student at Georgia Law School, worked as a part-time law clerk at the prestigious firm of Foote, Ball, & White. He was permitted to borrow law books and legal treatises to take home for his own personal use. One afternoon Hayden was preparing a brief in the firm's law library when he noticed a book entitled Promiscuity in Law School lying on the conference table. Making sure no one was watching him, he took the book and placed it in his attache case. He planned to take the book home that night with the intention of not returning it.

A short while later, Hayden was about to leave the law office when he was stopped by Chandler, an associate in the firm, who asked him to open his attache case. Chandler explained that some files from the law office had been stolen. As a result, he was conducting a "spot check" of employees to determine who was responsible for the thefts. Startled, Hayden refused to permit Chandler to look in his attache case. Hayden said that he had just purchased a new issue of "Hustler" magazine and he was embarrassed to have Chandler see it. Having his suspicions aroused, Chandler raised his clenched fist and exclaimed, "Bullshit! If you don't hand over that (bleep) attache case, I'm going to bust you in the mouth." Hayden, who unknown to Chandler, suffered from a serious heart condition, had a seizure and died as a result of fright produced by the threatened attack.

Which of the following is the most serious crime of which Chandler should be found guilty?
